Anybody hear anything concrete about the barbless hook rule changing in Alberta. I heard rumours that it is.

I heard that they plan on repealing the barbless rule and that barbs on our hooks will no longer be illegal. I also heard that they are currently not enforcing the barbless law as the rule will change in the next regs.

Barbs only hurt fish if the fisherman is careless and impatient...

I called ESRD and got confirmation that the Federal Fisheries act was re written and there were no provisions for barbless hooks, so until the Federal law is changed, there will be no enforcement of the barbless laws in Alberta. The changes were made in September 2011, and the Government in Alberta found out about this change in October 2012. Apparently about 530 people have been ticketed and they plan to drop charges, and repay fines.

We can use barbs again until this legislation is changed Federally.

I called the 310-3773 number for ESRD. I asked for a clarification in an email, and the guy said he would send me one. I am still waiting for it. In the meantime I confirmed this information with someone else I know in fisheries, or whatever it's called now.

It's been government knowledge for a while, and the public is just finding out. Wait a second, our Government would never do something like that!

Thank you for contacting the Alberta Environment and Sustainable Resource Development Information Centre.

When the Fisheries Act (of Canada) was amended on September 22, 2011, the prohibition on the use of barbed fish hooks was removed. The Alberta Fishery Regulations were updated to reflect this, and as such, this made the ban on the use of barbed fish hooks unenforceable.

Fish and Wildlife officers have ceased charging people for using barbed hooks and will not swear tickets issued since the change in legislation. We are also moving to quash all wrongful convictions and refund all fines paid since the change in legislation.

I recieved a few responses. This was added to my last one. Seems somebody still thinks barbless hooks should be the law.

"It’s unfortunate that this situation has occurred, but we’re working with the Government of Canada to determine the appropriate next steps as we consider the current lack of a barbed hook ban. We propose to consult with Alberta’s sportfishing stakeholders to review the need for a barbed book ban before we make a decision to request that it be re-introduced in the federal regulations. This will take some time.

In the meantime, we want to encourage Alberta’s anglers to continue to use barbless hooks and remember that we are promoting proper handling techniques for all fish caught that are to be released to best ensure their survival. We are blessed to live in a province with abundant natural beauty with immense recreational value, and we want to ensure we sustain that for the future."

Here is the explanation I recieved from the Information Officer at Alberta ESRD.

"There is an agreement in place between the government of Alberta and the federal government and the enforces the Fisheries Act (federal) on a provincial level. On September 22, 2011 the Fisheries Act was amended - removing the prohibition of barbed hooks.

Alberta Fish and Wildlife officers were not informed of the change until Oct 19, 2012. Fish and Wildlife officers have charged approximately 590 people since the change in the legislation, but we are moving to withdraw any charges wipe any convictions and repay fines."

Thanks for the explanation, Chris. I didn't realize the Federal Fisheries Act was the responsible body for the barbless regulation in Alberta. It makes sense now because that explains why Saskatchewan and Manitoba went barbless recently as well.

It will be interesting to see if Alberta ESRD has the ability and will to establish a provincial barbless law without the backing of the Federal law.

I have mixed feelings about the barbless regulation and believe that it is a situation dependant decision whether barbed or barbless hooks should be used. There is a time and place for both. A responsible angler would be able to identify these situations.

i have like a 40lb arsenal of lures that are debarbed... lol might aswell shrug it off. i felt like it sucked when the law was first introduced but now it kinda makes sense. i say keep the law or promote barbless!

Good question to ask.
I phoned edmonton fish and wildlife office to confirm and they are quite vague about the 2013 regulations. More bureaucratic bs

for the short term. Fines that were handed out will be returned.
